We may identify you as the author using your name, email address, or screen name as we deem appropriate. We are under no obligation to provide credit or compensation for your submissions.

 

Content Standards

You expressly agree not to post User Content that:

• Is illegal, threatening, defamatory, obscene, or invasive of privacy

• Constitutes commercial solicitation, spam, mass mailings, or chain letters

Copyright Infringement Claims

Dispute Resolution

Governing Law

These Terms, along with the Accept Finance LLC Privacy Policy, constitute the complete and exclusive agreement between you and Accept Finance LLC regarding the Site and services, superseding all prior agreements, proposals, or communications. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

 

Arbitration Requirement

Any dispute, claim, or controversy arising from or relating to these Terms, your use of the Site, or your relationship with Accept Finance LLC shall be resolved through binding confidential arbitration in New York, New York, conducted under the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

 

Exception for Intellectual Property Claims

Notwithstanding the arbitration requirement, if you violate or threaten to violate our intellectual property rights, Accept Finance LLC may seek injunctive or other equitable relief in the state courts of New York or the United States District Court for the Southern District of New York. You consent to the exclusive personal jurisdiction and venue of these courts for such matters.

 

Individual Proceedings Only

All dispute resolution proceedings shall be conducted solely on an individual basis. You expressly waive any right to participate in class actions, consolidated proceedings, or representative actions. The parties acknowledge that the agreement to arbitrate on an individual basis constitutes consideration for this waiver.

 

Limitation Period

ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATED TO THESE TERMS OR THE SITE MUST BE FILED WITHIN ONE (1) YEAR FROM THE DATE THE CAUSE OF ACTION ACCRUED. AFTER THIS PERIOD, SUCH CLAIMS ARE PERMANENTLY BARRED.

 

Modifications to Dispute Resolution Terms

If Accept Finance LLC modifies these dispute resolution provisions, such modifications shall not apply to claims that arose prior to the effective date of the modification.

 

Jury Trial Waiver

In the event arbitration is prohibited by applicable law, both parties waive all rights to trial by jury and agree not to participate in any class, consolidated, or representative proceedings.
